These Terms of Use (“Terms”) govern your access to and use of the website located at https://sunprise.com (the “Site”) and any related online content, forms, tools, or communications operated by SUN4 INC d/b/a Sunprise (“Sunprise,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms apply to website use only. Professional construction, remodeling, roofing, solar, generator, electrical, and related field services are governed separately by our Términos de Servicio and by written project agreements signed with Sunprise.

1. Eligibility and account security

You must be at least 18 years old and able to form a binding contract to use the Site. You are responsible for maintaining the confidentiality of any credentials you use on the Site and for all activity under those credentials.

2. Permitted use

You may use the Site for lawful, personal, or business purposes related to learning about Sunprise services, submitting inquiries, scheduling consultations, and reviewing project information. You agree not to:

• Use the Site in violation of applicable federal, Florida, Texas, or local law;
• Attempt to gain unauthorized access to the Site, servers, APIs, or data;
• Scrape, crawl, harvest, or copy Site content or user submissions except as allowed by standard browser use;
• Upload malware, interfere with Site operation, or overload our systems;
• Misrepresent your identity, property ownership, licensing status, or affiliation with Sunprise;
• Use the Site to send unsolicited commercial messages or spam;
• Reverse engineer, decompile, or attempt to extract source code except where prohibited restrictions are unenforceable by law.

3. No professional advice on the Site

Site content is provided for general information only. It is not engineering, legal, tax, financing, insurance, or building-code advice. Project requirements vary by municipality, utility, insurer, and property condition. Permits, inspections, wind-load requirements, utility interconnection rules, and manufacturer specifications must be confirmed for your specific project before work begins.

4. Estimates, pricing, and availability

Any pricing ranges, examples, calculators, blog posts, FAQs, or verbal discussions referenced on the Site are illustrative only. They are not offers, bids, or guarantees. Binding scope, price, schedule, and warranty terms appear only in a written agreement executed by Sunprise and the customer. Financing references, where shown, are subject to credit approval; Sunprise does not guarantee approval, rates, or program availability.

5. Intellectual property

The Site, including text, graphics, logos, photographs, videos, page layout, and software, is owned by Sunprise or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws. You may view and print reasonable portions of the Site for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit Site content without our prior written consent, except as permitted by law.

“Sunprise,” associated logos, and other marks are trademarks of SUN4 INC or its affiliates. Third-party marks, including Generac and other manufacturer names, belong to their respective owners.

6. User submissions

When you submit information through contact forms, quote requests, uploads, reviews, or other Site features, you represent that the information is accurate to the best of your knowledge and that you have the right to provide it. You grant Sunprise a non-exclusive, royalty-free license to use submissions to respond to your inquiry, provide services, improve operations, and comply with law. Our use of personal information is described in the Política de Privacidad.

7. Third-party links and tools

The Site may link to third-party websites, permit portals, utility sites, manufacturer pages, review platforms, mapping tools, or financing partners. Sunprise does not control and is not responsible for third-party content, privacy practices, or availability. Your use of third-party services is at your own risk and subject to their terms.

8. Electronic communications

By using the Site or submitting your contact information, you consent to receive communications from Sunprise electronically, including email, SMS/text messages where you provide a mobile number and consent, and phone calls, as described in our Privacy Policy and applicable telemarketing laws. You may opt out of marketing messages as stated in the Privacy Policy; service-related communications may still be sent when necessary to respond to your request or perform a contract.

9. Disclaimer of warranties

THE SITE AND ALL SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUNPRISE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT INFORMATION ON THE SITE IS COMPLETE OR CURRENT.

Some jurisdictions, including Florida and Texas, do not allow certain warranty exclusions. In those jurisdictions, the above exclusions apply only to the extent permitted by law.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNPRISE AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNPRISE’S TOTAL LIABILITY FOR WEBSITE-RELATED CLAIMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID SUNPRISE FOR WEBSITE-RELATED PAID SERVICES, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under Florida or Texas law, including liability for gross negligence or intentional misconduct where such limitation is prohibited.

11. Indemnification

You agree to defend, indemnify, and hold harmless Sunprise and its personnel from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party rights.

12. DMCA / copyright complaints

If you believe material on the Site infringes your copyright, send a notice to info@sunprise.com with: (a) identification of the copyrighted work; (b) identification of the material and its location; (c) your contact information; (d) a good-faith statement of unauthorized use; (e) a statement under penalty of perjury that your notice is accurate and you are authorized to act; and (f) your physical or electronic signature. We may remove or disable access to allegedly infringing material and terminate repeat infringers where appropriate.

13. Governing law and venue for Site disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your state of residence apply. Any dispute arising solely from Site access or use that is not subject to arbitration in a separate signed agreement shall be brought in the state or federal courts located in Hillsborough County, Florida, and you consent to personal jurisdiction there.

Construction and field-service disputes are governed as described in our Términos de Servicio and written project contracts.

14. Changes to these Terms

We may update these Terms from time to time. The “Effective date” at the top indicates when the current version took effect. Material changes will be posted on this page. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

15. Severability and entire agreement for Site use

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and Terms of Service to the extent incorporated by reference, constitute the entire agreement regarding Site use.
