These Terms of Service (“Service Terms”) describe how SUN4 INC d/b/a Sunprise (“Sunprise,” “we,” “us,” or “our”) provides remodeling, roofing, room additions, whole-home renovation, commercial solar, standby generator, electrical, insulation, and related construction services in Florida, Texas, and other locations where we are licensed and actively operate.
By requesting a consultation, accepting a proposal, signing a contract, making a deposit, or allowing Sunprise to begin work, you (“Customer,” “you,” or “your”) agree to these Service Terms except where a signed written agreement expressly overrides them. Website use is governed separately by our Terms of Use.
1. Licensing and company information
Sunprise performs work through SUN4 INC, a licensed and insured contractor. Current license information:
- Florida licenses: CVC57137, EC13010258, CCC1337075 (verify at Florida DBPR License Lookup)
- Texas contractor registration/license: 40716
License numbers, qualifying agents, and scope classifications may be listed on your written contract and must be verified for the state and county where the project is located. Sunprise will not perform work requiring a license in a jurisdiction where it is not properly licensed unless otherwise disclosed in writing and permitted by law.
2. Services covered
Depending on project scope, Sunprise may provide design coordination, estimating, permitting, material procurement, installation, inspection scheduling, commissioning, and warranty documentation for services including, without limitation:
- Kitchen, bathroom, and whole-home remodeling;
- Room additions and structural alterations;
- Roof repair and replacement under applicable Florida wind codes or Texas/local requirements;
- Commercial solar and related electrical coordination;
- Generac standby generator installation and related electrical work;
- Insulation upgrades and selected electrical scopes.
Sunprise installs Generac standby generators as an independent authorized dealer. Generac Power Systems, Inc. is not the contractor of record for installation work performed by Sunprise. Manufacturer product warranties are provided by the manufacturer under its published terms; installation workmanship warranties, if any, are stated in your contract.
3. Quotes, proposals, and contracts
Verbal estimates, email summaries, website forms, and preliminary proposals are non-binding until a written contract or change order is executed by authorized representatives of both parties. A binding agreement must clearly identify scope, materials, allowances, schedule milestones, price, payment schedule, warranty terms, and permit responsibility.
Site conditions, hidden damage, code upgrades, engineering requirements, HOA or utility delays, and change requests may affect final price and schedule. Sunprise will use commercially reasonable efforts to notify you of material changes before proceeding when practicable.
4. Permits, inspections, and code compliance
Unless otherwise stated in writing, Sunprise coordinates permit applications and inspections for in-scope work in the project jurisdiction. Final approval depends on authorities having jurisdiction, utility providers, manufacturers, and third-party inspectors. Customer agrees to provide reasonable access, accurate property information, and required owner signatures for permit applications.
Work is performed to applicable building, electrical, fire, and energy codes in effect for the project location at the time of permit issuance, subject to approved plans and manufacturer specifications.
5. Customer responsibilities
Customer agrees to:
- Provide safe access to the job site and secure pets, valuables, and sensitive areas;
- Disclose known hazards, prior repairs, asbestos/lead/mold concerns, and property restrictions;
- Maintain active insurance on the property as required by lender or law;
- Obtain HOA, architectural review, or landlord approvals when applicable;
- Make timely decisions on selections, allowances, and change orders;
- Pay invoices according to the agreed schedule.
Delays caused by customer nonperformance may extend the schedule and, where permitted by contract and law, adjust project costs.
6. Payment terms
Payment amounts, deposit limits, draw schedules, retainage, and accepted methods are set forth in the written contract. Deposits and progress payments must comply with applicable Florida and Texas consumer-protection and construction laws. Sunprise may suspend work for nonpayment after providing notice required by contract and law.
Late payments may accrue interest or collection costs where permitted by contract and law. Customer remains responsible for bank fees, chargebacks, or returned payment costs caused by Customer.
7. Financing
If financing is offered or arranged, it is provided by third-party lenders or programs subject to credit approval. Sunprise does not guarantee approval, interest rates, terms, or availability. Financing marketing on our Site or in sales materials is informational only. Customer must review and sign lender disclosures independently of these Service Terms.
8. Change orders
Changes to scope, materials, or schedule require a written change order signed by both parties before extra work is performed, except for emergency work necessary to protect persons or property, which will be documented promptly afterward. Unauthorized changes requested by Customer may be refused or billed separately if performed at Customer’s direction.
9. Warranties and disclaimers
Sunprise provides workmanship warranties only as expressly stated in the signed contract. Manufacturer warranties pass through to Customer where applicable and may require registration, maintenance, or inspections to remain valid.
EXCEPT AS EXPRESSLY STATED IN THE WRITTEN CONTRACT, SUNPRISE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Sunprise does not warrant that materials will be free from normal variation, that finished surfaces will match samples under all lighting conditions, or that utility savings, production estimates, or storm-performance outcomes will meet illustrative projections unless expressly guaranteed in writing.
10. Limitation of liability for services
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUNPRISE’S TOTAL LIABILITY FOR ANY PROJECT-RELATED CLAIM WILL NOT EXCEED THE AMOUNT PAID BY CUSTOMER TO SUNPRISE FOR THE SPECIFIC PROJECT GIVING RISE TO THE CLAIM, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.
SUNPRISE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST RENT, LOST PROFITS, LOSS OF USE, OR PERSONAL INCONVENIENCE, EXCEPT WHERE PROHIBITED BY LAW.
Some states do not allow certain limitations; in those cases, limitations apply only to the extent permitted.
11. Florida construction lien law notice
Florida customers: Under Florida’s Construction Lien Law (Chapter 713, Florida Statutes), contractors, subcontractors, suppliers, and others who provide labor, services, or materials for improvement to real property may have the right to claim a lien against your property if they are not paid. You may receive notices from Sunprise or others describing lien rights. Before paying your contractor, you may wish to confirm that subcontractors and suppliers have been paid or that appropriate lien releases have been obtained. For current statutory language and your rights, consult Florida Statutes Chapter 713 or qualified legal counsel.
12. Texas residential construction notice
Texas residential customers: Texas law provides certain warranties, inspection rights, and remedies for residential construction defects under the Texas Property Code and related statutes, including provisions commonly referred to as the Residential Construction Liability Act. Your contract may include additional statutory disclosures. Nothing in these Service Terms waives rights that cannot be waived under Texas law.
13. Cancellation and rescission rights
If applicable federal, Florida, or Texas law grants you a right to cancel a transaction within a specified period—for example, certain door-to-door, home-solicitation, or remote-sales contracts—Sunprise will honor those rights and provide any required notice at the time of sale. Statutory cancellation rights, if any, are in addition to contractual terms in your signed agreement.
14. Insurance and risk of loss
Sunprise maintains commercial insurance appropriate to its operations. Customer should maintain homeowner’s or commercial property insurance covering the structure and contents. Risk of loss for materials stored on site and for completed work may be addressed in the written contract and applicable law.
15. Dispute resolution
Parties will first attempt in good faith to resolve disputes through direct discussion. If a signed contract includes mediation or arbitration provisions, those provisions control for project disputes. Otherwise, service disputes may be brought in the courts of the county where the project is located, or as required by mandatory consumer-protection law.
Nothing in these Service Terms prevents either party from seeking temporary injunctive relief or reporting matters to licensing boards, building departments, or consumer protection agencies.
16. Governing law for services
Except where mandatory consumer-protection law provides otherwise, construction and field-service disputes are governed by the laws of the state where the project is performed. If the project state cannot be determined from the contract, Florida law applies.
17. Force majeure
Sunprise is not liable for delays or failures caused by events beyond reasonable control, including severe weather, hurricanes, utility outages, material shortages, labor disruptions, government actions, pandemics, or permit office closures. Schedule adjustments will be communicated when practicable.
18. Assignment and subcontractors
Sunprise may use qualified employees, subcontractors, and suppliers to perform work while remaining responsible for contract performance as stated in the written agreement. Customer may not assign a project contract without Sunprise’s written consent, except to a successor property owner where permitted by law and lender requirements.
19. Privacy and communications
Personal information collected in connection with services is handled under our Privacy Policy. By engaging Sunprise, you consent to service-related calls, texts, and emails to the contact information you provide, including appointment reminders and project updates, and to marketing communications where you have given consent required by law.
20. Changes to these Service Terms
We may update these Service Terms from time to time. The Effective date above shows the current version. Updates apply to new inquiries and contracts signed after posting unless a signed agreement states otherwise.
